ANY USE OF THE REDEYE SERVICE INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS OF USE.

AGREEMENTS TO TERM OF USE
These Terms & Conditions of Use ("Terms of Use") apply to general access and use of the REDEYE quotation service for rapid prototype parts (the "Service"), other than specific part quotations or orders, which are governed by a separate Customer Agreement, the then-current terms of which are incorporated by reference herein.

The REDEYE web site (accessible via au.redeyeondemand.com, sub-domain http://au.redeyeondemand.com) (the "Site") has been established to support the Service, and by using this Site, you acknowledge that you have read and agree to all then-current Terms of Use. If you do not agree, do not use the Site or the Service. REDEYE also reserves the rights to terminate access or use of the Site following any violation of these Terms of Use, or REDEYE’s other rights, or for any use that is otherwise illegal, harmful or inappropriate.

COPYRIGHTS AND TRADEMARKS
The copyrights, trademarks and all other intellectual property law rights in all material provided on this Site belong to REDEYE or its licensors. Except as authorized below, none of this material may be reproduced, copied, distributed, republished, downloaded, displayed, posted or transmitted in any form with out the prior written consent of REDEYE.

PRIVACY POLICY
This Privacy Policy sets out REDEYE's policy with regard to the use and disclosure of identifiable information collected by REDEYE from users of the Site, excluding proprietary information that customers may submit to REDEYE when requesting, which is subject to the Customer.

Personally Identifiable Information

REDEYE only collects personally identifiable information (such as name, address, and e-mail address) about users of the Site that is voluntarily submitted by the user ("you") as part of the registration process. REDEYE will retain the registration information you submit in a specific file. When you voluntarily submit such personal information, you are consenting to receive emails from REDEYE from time to time regarding its products or services, as well as periodic REDEYE marketing events or promotions. If you do not wish to receive such information from REDEYE, you may send a message opt-out of these communications at any time by sending an e-mail to enquiries@redeyerpm.com.au.

REDEYE will not disclose your personally identifiable information to any third parties, except to the extent such disclosure is: (a) necessary to provide services to you (including for example by providing your name and address to a courier company so that your models can be delivered to you) or to enforce the Customer Agreement; or (b) required by applicable laws or regulations or by court or administrative order.

Non-Personally Identifiable Information

REDEYE reserves the right to track non-personal information about your use of its Website, including without limitation, the URL that you have accessed the Site from (whether or not this URL is the Site), the URL you go to next (whether or not this URL is on the Site), the type of Internet, operating system or other access devices being used, and your location and IP address. A user’s IP address may be used for marketing or advertising purposes; for system administration purposes; and to track a user’s session, in order to enhance future Site use and improvements.

This Privacy Policy will remain in effect unless and until an amended policy is posted on the Site.

General Compliance with Laws
You shall comply with all applicable laws and regulations in connection with your use of the Site.

Your use of the Site is at your own risk. REDEYE makes no warranties or representations as to the Site and assumes no liability or responsibility for any errors or omissions therein. As access and use of the Internet can never be 100% secure, REDEYE also assumes no responsibility, and shall not be liable for, any damage to, or viruses that may infect, your computer equipment or other property on account of your access to or use of the Site.

Access and Use of Information and Password
When you become a registered customer, you will log in by using your e-mail address and a password, which will be for your use only. You must not share your password or disclose it to third parties. You are responsible for all access to and use of the Site using your e-mail address and password. Customers whose employees or agents have used the Customer's e-mail address and password for the Site will be deemed to have authorized any access, use or misuse of this Site (including without limitation all orders placed through the Service) by such employees or agents or any person using their e-mail address or password. Access to this Site is limited to viewing the linked web pages solely for legitimate business purposes to access the information provided by REDEYE at this Site and to use the Services. Any access or attempt to access other areas of the REDEYE computer system or other information contained on the system for any purposes is strictly prohibited. REDEYE reserves the right in its discretion to suspend or cancel your registered customer status at any time without notice. Upon such cancellation, you will no longer be permitted to access the Site.

All intellectual property law rights in the Site content are owned by REDEYE and are hereby reserved. REDEYE hereby authorizes you to make a reasonable number of copies of Site content for your internal use in learning about, evaluating, or acquiring Services. You agree that any copy made must include the notice '© 2008 REDEYE. All Rights Reserved'. No other permission is granted to you to print, copy, reproduce, distribute, transmit, upload, download, store, perform, display in public, alter, or modify the content contained on or in this Site.

Indemnity
In consideration of your access to the Site, you shall indemnify and hold harmless REDEYE from and against any loss, liability, damages, costs and expenses (including reasonable attorneys' fees) suffered or incurred by REDEYE arising from your breach of these Terms of Use, or your negligent, willful, fraudulent or unlawful act or omission in connection with your use of the Site.
